Provisional Patent Application
The provisional application process gives inventors a low-cost option for first patent filing. Patentability is based on the provisional application date, but the 20-year patent term is based on the actual patent filing date, which can be up to 12 months after the provisional application.
Because the provisional patent process is more simple than the full patent application, it requires a much lower initial investment on the part of the inventor, and provides up to a year to determine the commercial potential of the concept. Inventors can then legally use the term "Patent Pending" in relation to their invention. They can publicize their idea while protecting it.
