  • Thomas Capano is a Delaware lawyer (now disbarred). He was convicted of the 1996 murder of 30-year-old Anne Marie Fahey, his former mistress. Fahey had reportedly ended their relationship and started dating another man. According to the testimony of Capano's brother Gerard Capano, the two of them had placed the body in an ice chest, sailed out to sea and dumped it 60 miles off coast. Capano was convicted and given the death penalty, but the sentence was subsequently overturned and reduced to life in prison.

On March 18, 2008, a Delaware Judge heard the appeal of Capano's lawyers to overturn the conviction. The lawyers argued that hearsay was admitted as evidence in the original trial, and that the jury was given no lesser option for conviction than first-degree murder.Deleware Online: U.S. Judge Turns Down New Trial for Capano (April 16, 2009)
