Merrill Lynch investment banker Robert Kissel was drugged and bludgeoned to death on November 2, 2003. His wife Nancy Kissel was convicted and sentenced to life in prison in Hong Kong for the murder and became known as the "Milkshake murderer". The original case said that Nancy Kissel had given her husband a milkshake like drink, which was laced with drugs and then attacked Robert with a statue whilst he slept. On February 11, 2010, the highest court in Hong Kong, the Court of Final Appeal, overturned the conviction, partly because evidence was used against her in the trial which should not have been allowed. On February 18, 2010 a Hong Kong appellate court ordered a retrial citing "numerous elements of grave concern" after reviewing the case.http://www.postchronicle.com/news/breakingnews/article_212284156.shtml The judgement said that "The court unanimously allows the appeal, quashes the conviction and orders a retrial. The court further orders that the appellant be remanded in custody pending retrial."

Nancy Kissel began proceedings to appeal the conviction on April 14, 2008. She claimed Robert Kissel was a violent cocaine addict who threatened her with a baseball bat.
