  • Death Penalty for Rape

    Because of the unusual circumstances of the case, Kennedy received the death penalty for his crime, and is one of only two criminals on death row for a non-murder offense. His case is currently on the Supreme Court docket and will be decided by the high court during the 2008 term.

    Kennedy became the first person in over 25 years to receive a capital sentence for a felony other than murder. In 1995, Louisiana passed a law allowing execution for the sexual violation of a child under 12.
