One of the five officers involved in the attack, Kevin Maloney, testified to the grand jury that he had seen officer Richard Kern place his baton near Mineo's buttocks.

Grand Jury
On December 6, 2008, the grand jury investigating the case agreed to indict three of the five police officers involved in the incident. Officer Richard Kern was charged with aggravated sexual abuse and assault, and if convicted faces up to 25 years in prison. Fellow officers Alex Cruz and Andrew Morales have been charged with trying to cover up the incident and hindering prosecution; if found guilty, they could be sentenced to four years in prison. Mineo's DNA has reportedly been found on Kern's baton. -
