He was said to have learned of the birth after reading about it online. Rutherford married Daniel Giersch in 2006. The couple have a son together and Rutherford gave birth to the couple's baby girl on June 8, 2009. Rutherford and Giersch filed for divorce at the Los Angeles County Superior Court on January 3, 2009, and have subsequently become involved in a heated custody battle. Both Rutherford and Giersch claim that they are the primary caregiver to their son, Hermes Gustaf Giersch, while accusing the other of violent behavior.

Rutherford has expressed concern that Giersch, who is not a U.S. citizen, will leave the United States with their son and Giersch tried to prevent Rutherford from traveling to New York City for her work. On January 23, 2009, a judge ruled that Rutherford is permitted to take her son to New York City while she films Gossip Girl. He also stated that Giersch is free to travel there as well. For the month of February, the judge awarded Giersch two overnight visits with Hermes per week. For March, he was allowed three visits per week.
