How to Sell Marijuana Legally

If you would like to know how to sell marijuana legally to approved medical patients, it is important to know the laws of the state you live in. Currently, there are fourteen states that have legalized the medicinal use of marijuana for patients with terminal and/or painful illnesses. Each state has its own regimen for the distribution of marijuana, and the legalization is only recognized on the state level. It is still considered a federal crime to sell or buy marijuana in the United States, despite individual state policies and laws regarding marijuana.http://www.safeaccessnow.org/article.php?id=2638

As more and more states legalize the distribution of marijuana to patients with long-lasting painful and terminal illness, someone must take responsibility for that distribution. Each state has different policies, licensing procedures and job opportunities for selling marijuana.http://norml.org/index.cfm?Group_ID=4525While some states have taken precautions to protect the identity of patients and doctors, there are no precautions for medical marijuana distributors at this time.

The fourteen states that currently have designed a system for patients to obtain medical marijuana: Alaska, California, Colorado, Hawaii, Maine, Michigan, Montana, Nevada, New Jersey, New Mexico, Oregon, Rhode Island, Vermont, and Washington.http://medicalmarijuana.procon.org/view.resource.php?resourceID=000881

Step 1: Where Can Marijuana Be Sold Legally?

  • Is it legal to sell marijuana? That is the question. Each of the fourteen states which have legalized marijuana impose different laws concerning the purchase and distribution of marijuana. Here is a breakdown of each participating state's policy on the sale and possession of marijuana:
  1. Alaska: 1 usable ounce and 6 plants are permitted. Health conditions must be approved by a doctor and state registration is mandatory.
  2. California: 8 ounces and 18 plants; Mandatory state registration.
  3. Colorado: 2 ounces, 6 plants; Registration is voluntary.
  4. Hawaii: 3 ounces, 7 plants; Mandatory registration.
  5. Maine: 2.5 ounces, 6 plants; Program in development
  6. Michigan: 2.5 ounces, 12 plants; Registration is mandatory.
  7. Montana: 1 ounce, 6 plants; Mandatory state registration.
  8. Nevada: 1 ounce, 7 plants; Mandatory registration.
  9. New Jersey: 2 usable ounces allowed; A program is currently under development.
  10. New Mexico: 6 ounces, 16 plants; State registration is mandatory.
  11. Oregon: 24 ounces, 24 plants; Registration is mandatory
  12. Rhode Island: 2.5 ounces, 12 plants; Mandatory registration.
  13. Vermont: 2 ounces, 9 plants; Mandatory state registration
  14. Washington: 24 ounces, 15 plants; No registration is required.http://norml.org/index.cfm?Group_ID=4516

Step 2: Obtaining A License

  • Marijuana dispensaries and distributors in participating states must apply for and undergo a licensing process with their respective state. Nine of the fourteen states with an established medical marijuana policy have removed criminal implications at the state level from the the sale and use of marijuana, imposed conditions (namely specific medical conditions confirmed by a physicians) around the eligibility for medical marijuana use, and created state programs for the purpose of registration and licensee. The remaining states have decriminalized medical marijuana use and distribution and are either in the process of developing a medical marijuana registration program, or opt to forgo requiring registration at the current time. Guidelines, fees and requirements vary from state to state and are typically exhibited on official state websites.http://www.sonoma-county.org/health/ph/vitalstatistics/mmp_faq.htm While most states which require a license don't recognize licenses from other states, some will honor a registration from another state provided that the requirements for obtaining a license or the approved medical conditions such as cancer, glaucoma, HIV/AIDS, Hepatitis C, cachexia or wasting syndrome, severe or debilitating chronic pain, severe nausea, seizures, epilepsy, muscle spasms, Crohn’s disease and Alzheimer's Disease, coincide.

Step 3: Working in a Collective Dispensary

Dispensaries are small clinics that are designed to aid patients who suffer from painful and/or terminal illnesses by providing access to medical grade marijuana as well as food and paraphernalia. In these clinics, patients receive alternative treatment and relief through the supervised use of marijuana. In certain states, dispensaries must be not for profit outfits, and require patients or customers to furnish a state identification card to gain access. In order to qualify for a registration or a license, an individual must provide proof of residency in the state in which (s)he wishes to grow, sell or buy marijuana.http://www.cdphe.state.co.us/hs/medicalmarijuana/fullpacket.pdf

If you are interested in working with terminally ill patients, as well as patients with chronic pain as a marijuana grower or dispenser, your best bet would be working in a collective dispensary clinic. California, Colorado, Hawaii, Vermont and Maine all distribute marijuana through collective dispensaries. Dispensaries typically obtain medical marijuana from local growers who are also impacted by state medical marijuana laws with respect to quantities and licensee. While the sale of marijuana is not permitted outside of the dispensary, employees of a dispensary become an integral part of the medical marijuana process. Becoming politically or socially active in the medical marijuana community may result in a network of equally minded individuals and potential job offers.https://www.cannabiscareerinstitute.com/cannabis-school/how-to-market-yourself
