At present, there are thirteen states that have legalized the medicinal use of marijuana for patients with terminal and/or painful illnesses. Each state has its own regimen for the distribution of marijuana, and the legalization is only recognized on the state level. It is still considered a federal crime to sell or buy marijuana in the United States. If you live in one of the thirteen states and would like to know how to sell marijuana legally to approved medical patients, please read on.

Introduction
- As more and more states legalize the distribution of marijuana to patients with long-lasting painful and terminal illness, someone must take responsibility for that distribution. Each state has different policies on the selling of marijuana. Please read on to learn more about licensing procedures and job opportunities.

Where Can You Sell Marijuana Legally?
- Is it legal to sell marijuana? That is the question. There are currently thirteen states who have legalized the medicinal use of marijuana. Each one of these thirteen states has different laws surrounding the purchase and distribution of marijuana. Here is a breakdown of each participating state's policy on the sale of marijuana:
- Alaska: does not offer any way for patients to legally buy or sell marijuana
- Arizona: must obtain a license from the state to sell/distribute marijuana
- California: must work for a collective or cooperative dispensary agent to distribute
- Colorado: does not offer any way for patients to legally buy or sell marijuana
- Hawaii: does not offer any way for patients to legally buy or sell marijuana
- Maine: must work for a collective or cooperative dispensary agent to distribute
- Maryland: no provisions in the state of Maryland for access to or sale of medical marijuana
- Michigan: provisions in the state of Michigan for access to or sale of medical marijuana have not yet been defined
- Montana: does not offer any way for patients to legally buy or sell marijuana
- Nevada: does not offer any way for patients to legally buy or sell marijuana
- New Mexico: must obtain a license from the state to sell/distribute marijuana
- Oregon: does not offer any way for patients to legally buy or sell marijuana
- Rhode Island: does not offer any way for patients to legally buy or sell marijuana
-
Obtaining A License
- Marijuana dealers in Arizona and New Mexico must go through the state to obtain a license. They must also acquire tax stamps showing that they have paid the state tax requirements on all sales of marijuana.
- An annual fee of $100 is required to become licensed to sell marijuana.
- Tax stamps are $10 per every ounce you sell.
- All fees are payable to the Department of Revenue.

Working in a Collective Dispensary
- If you are interested in working with terminally ill patients, as well as patients with chronic pain, as a marijuana grower or dispenser, your best bet would be working in a collective dispensary clinic. California and Maine both distribute marijuana through collective dispensaries. You will not be allowed to sell marijuana outside of the dispensary, but as an employee of the dispensary you will become a part of the process.
-
Conclusion
- The federal government considers marijuana a control one drug, which means that distribution of that drug is illegal. While some states have taken precautions to protect the identity of patients and doctors, there are no precautions for medical marijuana dealers at this time. There are currently four states that have designed a system for patients to obtain medical marijuana. California and Maine allow collective and cooperative dispensation, while Arizona and New Mexico require dealers to become licensed through the state.
WARNING! THE USE, POSSESSION, DISTRIBUTION, AND MANUFACTURE OF MARIJUANA REMAINS A FEDERAL
CRIME IN COLORADO, AND POSSESSION OF A REGISTRATION CARD PROVIDES NO PROTECTION WHATSOEVER
AGAINST FEDERAL CRIMINAL PROSECUTION.
