The pioneering New Wave band Devo is reportedly suing the fast food chain McDonald's for copyright infringement. As part of an American Idol-themed promotion, McDonald's created a toy figuring named New Wave Nigel, which wears a hat trademarked by the quirky band.

New Wave Nigel is one of four figurines placed in Happy Meals as part of the American Idol promotion. The other figurines were named "Soulful Selma," "Hippie Harmony" and "Rockin' Riley."
