McKinley was elected the 3rd District Delegate to the West Virginia Legislature in 1981, and served as a representative until 1994. He served on the Finance Committee, Banking and Insurance Committee, and Roads and Transportation Committee during his time in the legislature. He also served as the Chairman of the West Virginia Republican Party Executive Committee between 1990 and 1994. McKinley lost a 1996 race for the governorship of Massachusetts.
