Daniel Giersch is a German businessman and the estranged husband of Gossip Girl star Kelly Rutherford.

Rutherford gave birth to the couple's second child, Helena Grace Rutherford, on June 8, 2009. Giersch and Rutherford married in 2006 and had a son together in 2006. The couple filed for divorce at the Los Angeles County Superior Court on January 3, 2009, and have become involved in a heated custody battle. Both Rutherford and Giersch claim that they are the primary caregiver to their son, Hermes Gustaf Giersch, while simultaneously accusing the other of violent behavior. Giersch tried to prevent Rutherford from traveling to NY for her work and Rutherford has stated that she is concerned that Giersch, who is not a U.S. citizen, will leave the United States with their son.
