why do the employee serve the customers ice cream without using a napkin? hands all over your cone.

I can't see that they would be allowed to do that, but if they are I would complain to the manager and I would certainly not eat that. However if they are wearing gloves and touch themselves or money with the same gloves, you still can get bacteria on your food. I prefer when they use a fresh napkin to wrap around the cone and touch nothing but that napkin. That way you can throw it out if you want and your food is not been touched.
