So, I would say this is a disheartening trend. While I think it is unfair that two people commit the same crime and one goes free, part of me understands why.

M$More equivalent would be the prostitute vs. the john. Generally prostitutes pay fines, they don't go to jail. The pimps/madams, whatever are the real target of prosecutors.
