Despite the fact that Ruth Bader Ginsburg has been battling cancer, John Paul Stevens is the most likely justice to leave the supreme court next.

Ruth Bader Ginsburg has not missed a day on the bench while battling cancer, and appears to be on the road to recovery. She has successfully had tumors removed, and has shown that she will stick with the job through the hardest of times.

John Paul Stevens, at 88, is the oldest justice, and has been on the bench the longest. While I join others in wishing him the best of health, the reality is that he is the most likely to have health issues due to his advanced age.

Probably Ruth Bader Ginsburg.

She is undergoing Chemo

and she hinted that there will be a vacancy soon

Also Jeffery Toobin points out in his book that Democratic nominees leave when there are Democratic presidents and she was a Democratic nominee.

I think Ruth Bader Ginsburg will leave within the next two years, probably by quitting. Although she looked great at President Obama's "State of the Union" message, she's just been treated for some pretty serious health concerns. At nearly 76, I think she's the most likely one to consider retiring, a decision that may be made sooner due to declining health.
Second choice would be John Paul Stevens, who will turn 89 next month. He's served on the Supreme Court since 1975, a long stint at any job. He's also been considered liberal, so may believe the time is right to leave during Obama's administration.
