Some people see spanking as abuse to children, following that, spanking with a belt would be torture. For others, both of these would merely be punishments. So when does Punishment become abuse, and when does abuse become torture? It depends on the situation.
In domestic violence cases, it is abuse the first time. Following that, it becomes torture, or so the courts have ruled repeatedly. While the indivdual cases, it may differ, but overall, it becomes torture when it continues beyond the first incident. In interrogation, it tends to all be seen as torture. But then, that is how it is done. Once you go beyond mere questions and verbal threats, it is considered torture.
But to look at it from my own point of view.. it becomes torture when it is needless. When it is unprovoked. When it is done for amusement, or just for the sake of causing pain.

This is why I have always thought that child abuse should be classified as child torture, as often times the innocent child due to age, physical size or location, has no ability to flee or seek help.

The key word here is "excruciating". Purposely inflicting pain is abuse. Purposely inflicting excruciating pain is torture.
Torture is also usually prolonged, whereas abuse may not be. Hitting a child is abuse. Tying a child up for hours and hitting, burning, and raping them is torture. Causing your child to be hungry because you're a drug addict is abuse. Locking a child in the basement and refusing to feed them for days is torture.
Fear is also used as a means of emotional torture, as we saw with the waterboarding. The rationale for waterboarding was that there was no risk of the person actually dying, but it's terrifying to feel like you're going to drown, which could actually cause a heart attack in some people. At Abu-Ghraib, we saw prisoners tortured by being photographed naked, which in their religion, is something they could be punished for, and a supreme humiliation. The very threat of having that happen could cause them to give information, because of the serious emotional pain it caused.
So actually, the true definition of torture is "intentional and prolonged infliction of extreme mental distress and/or excruciating physical pain."
