Under the grounds that he did not "RAPE" her. Assult charges I understand but not rape. He simulated a Blow job, and banging her doggy style while she was Blacked out drunk and or high. "in a dream like state" as the prosecuter put it. She couldn't give a clear story as to what happened and changed her testimony to police at least 3 times. However, both parties WERE FULLY CLOTHED!! There was no physical penetration of any kind and her rape kit came back Negative. I know him personally and what happened to him was wrong. Giving him life for ALLEGED RAPE is stupid. . Feb 2017 is set to be his release date if all goes well.
