What recourse would a customer have if when applying for a car loan the salesperson misrepresented the...

I spoke with a lady today who is buried in a car she does not want and
can't afford. She says that when she was at the dealership applying
for the loan she told them she gets $892 / mo from Social Security.
After the loan went through and she got the car she somehow got a copy
of the credit app from the lender and it showed her income as being
1892/mo. She claims that the salesperson must have added the 1 to show
enough income for the loan.
Had the application gone through showing her real income, the lender
probably would not have granted the loan. Her bills are getting messy
and she is wondering what if any recourse she has against the dealer
that sold her the car.

She signed it, and she's responsible for the payments. After applying and being approved for a loan, you still need to sign the loan contract and agree. How exactly did your friend expect to make the payments when *she* knew what her income was?

Tell her to sell the car now, before she gets behind on payments, and take the bus. Even if the dealership misheard her and put down the wrong amount, she signed the documents and is ultimately responsible.

That's what i figured. She was a customer that came to my car lot and wanted to see if i knew of any way to get her out of her situation.

first apologize for being gruff but she shouldnt of takin the car if she couldnt afford that. Now this needs to be reported to the BBB. Also there are laws in certains states she can return the car within a certain amount of time. Also I would run her credit report at www.freecreditreport.com its free to see what her fico score is. Above all the car can be returned depended on state and restrictions. Free lawyer websites for questions on-line as well good luck.

I agree. Figure she's just tryin any way possible to get out of the car. Feel bad tho, senior citizen on social security ...told her i would post her situation here and see what sorta response it got. Thanks for everyone's help!

Please have her call her State's Attorney general, as this is against the law in most states. She'll have the burden of proof, as she signed it - but they would know more about what to do.
