What photos am I allowed to grab from Flickr? Can I grab anything so long as I give the author credit?

I don't have the money to buy stock photos quite yet, and so I'm hoping I can use Flickr as a good resource.

Thank you for helping out a complete newb...

Separate topics with commas, or by pressing return. Use the delete or backspace key to edit or remove existing topics.

You can leave an optional "tip" with Mahalo's virtual currency, Mahalo Dollars. If you are asking a difficult question that might require some research, or if you'd like a wide variety of feedback, a higher tip often leads to more answers to your question.

If you are looking at a picture on flicker, you will notice that each one has a label that tells you if you
  • can use the work (either non commercially or commercially)
  • can use the work commercially
  • can alter the work
  •  must give credit to the work.
You will find this on the right hand side of the page under "Additional Information" It looks like little circles. If you see the copyright symbol that means you can't use it because all rights are reserved. Here are some of the other symbols that you will see:

http://l.yimg.com/g/images/cc_icon_attribution.gif
Attribution means: You let others copy, distribute, display, and perform your copyrighted work - and derivative works based upon it - but only if they give you credit.

http://l.yimg.com/g/images/cc_icon_noncomm.gif
Noncommercial means: You
let others copy, distribute, display, and perform your work - and
derivative works based upon it - but for noncommercial purposes only.

http://l.yimg.com/g/images/cc_icon_noderivs.gif
No Derivative Works means: You let others copy, distribute, display, and perform only verbatim copies of your work, not derivative works based upon it.

http://l.yimg.com/g/images/cc_icon_sharealike.gif
Share Alike means: You allow others to distribute derivative works only under a license identical to the license that governs your work.

As a photographer, contrary to the last posters remarks I don't know of any artist who porduces art and is just happy to see it get used somewhere. you don't need a lot of money to buy stock photography, images for web use sell for $1 or less on the big stock sites like www.shutterstock.com, www.istockphoto.com, www.dreamstime.com, those are really the best three for cheap stock images, if you spend the dollar you have a huge range of what you are allowed to legally do with the image. be very careful as there is a new website that stock photographers like myself use to see if anyone has stolen my images called www.tineye.com with tineye you plug in your image and it scoures the internet to find all uses of the image, if you violate copyright infringement the consequences are similar to if you illegally downloaded music (if it is for personal pleasure) but if you are actually using it to assist in selling a product you can be sure that the artist will take you to the cleaners for that kind of infringement. Flickr photos can not be used on a website that sells anything even if you are just blogging and collecting money from clickthroughs that image is still considered as part of your marketing strategy. for the $1 you paid for this question you could have purchased an image.

this is taken from the T.O.S. on the Flickr site, and judging by what it says, I say yes you need consent from the owner of the copyright for any content uploaded  to the site.

  1. NOTICE AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT OR INTELLECTUAL PROPERTY INFRINGEMENT

    Yahoo! respects the intellectual property of others, and we ask our
    users to do the same. Yahoo! may, in appropriate circumstances and at
    its discretion, disable and/or terminate the accounts of users who may
    be repeat infringers. If you believe that your work has been copied in
    a way that constitutes copyright infringement, or your intellectual
    property rights have been otherwise violated, please provide Yahoo!'s
    Copyright Agent the following information:

    1. an electronic or physical signature of the person authorized to
      act on behalf of the owner of the copyright or other intellectual
      property interest;

    2. a description of the copyrighted work or other intellectual property that you claim has been infringed;

    3. a description of where the material that you claim is infringing is located on the site;

    4. your address, telephone number, and email address;

    5. a statement by you that you have a good faith belief that the
      disputed use is not authorized by the copyright owner, its agent, or
      the law;

    6. a statement by you, made under penalty of perjury, that the
      above information in your notice is accurate and that you are the
      copyright or intellectual property owner or authorized to act on the
      copyright or intellectual property owner's behalf.

Rosshans answer is excellent Although,Some photographers will label thier work as "stock" and list terms for use. The best way to use flickr for stock is to specifically send a request to the photographer detailing what you want to do with the image and how it will be used. A lot of the shooters on there may be open to certain kinds of use and closed to others.

Another excellent resource is www.deviantart.com there are artists on that site that produce work just for the pleasure of seeing it put to use elsewhere (it will be labeled as stock). The same rules apply to DA that apply to Flickr. check the photographers terms of use and when in doubt msg them and ask their permission.
