What do you do when a former employer has yet to give your W2 to you even though you have asked for it?

I have asked one of my former employers several times for my W2 and at this point it is holding me up on getting my taxes done. What should I do?

Separate topics with commas, or by pressing return. Use the delete or backspace key to edit or remove existing topics.

You can leave an optional "tip" with Mahalo's virtual currency, Mahalo Dollars. If you are asking a difficult question that might require some research, or if you'd like a wide variety of feedback, a higher tip often leads to more answers to your question.

By law, your W-2 was supposed to be postmarked by January 31st and received by February 15th. Since that date has already past, you need to contact the IRS representative who can initiate a Form W-2 complaint for you.

A letter will be sent to the employer requesting that they furnish a corrected Form W-2 to you within ten days. The letter advises the employer of their responsibilities to provide a correct Form W-2 and of the penalties for failure to do so.

You can reach the IRS by calling 800-829-1040. When you call and inform them of your need to file a complaint, you will need the following information:

*Your employer's name and complete address, including zip code, employer identification number (if known - see prior year's Form W-2 (PDF) if you worked for the same employer), and telephone number,
*Your name, address, including zip code, social security number, and telephone number; and
*An estimate of the wages you earned, the federal income tax withheld, and the period you worked for that employer. The estimate should be based on year-to-date information from your final pay stub or leave-and-earnings statement, if possible.

If you don't receive your Form W-2 by February 15, contact the IRS for assistance at (800) 829-1040.
