What can you do if a friend was hosting your website, and has no decided to keep it for their own???

My cousin was helping me with my 1st website, and after I did all the work, she said it wasn't making any $$$ and that she had to let it go, so I said ok. She didn't though. What she did was re-work it for her own. I'm pissed!!!

Separate topics with commas, or by pressing return. Use the delete or backspace key to edit or remove existing topics.

You can leave an optional "tip" with Mahalo's virtual currency, Mahalo Dollars. If you are asking a difficult question that might require some research, or if you'd like a wide variety of feedback, a higher tip often leads to more answers to your question.

In whose name is the website registered? If it is in yours, it is your intellectual property and you have the right to retain ownership, as well as force the other party to remove all of their content at their own expense.

But really, it is as bloody and expensive as you want to get into it--you can can bring suits based on copyright infringement, conversion, fraud, and false pretenses. If you had a contract of some kind, then there is possible breach of contract suit as well.

You can demand the return of your website as well as a portion of the profits the other party made through modifying your original code. Failing all that, you can file for an injunction which will shut down the site until either the suit is complete, or until you allow content back up.

Hope that helps.

Sorry for the delay in my response--I tend to check this site infrequently.

I am not sure about the rating, but the longer it has been around, the more hits it typically starts to get, making it rise in the search engine hits.

More advice....hmmm...that really and truly depends on what exactly do you want.

If you want a piece of her profit, sue for breach of contract and her unauthorized theft of your intellectual property.

If you want the website, that may be unlikely, but bring an injunction to prove ownership--you can try to maybe accused her of cyber squatting if the situation warrants it.

You can also be sneaky, file a formal US trademark on her site through the USPTO, and then accuse her of using YOUR ideas, since they were actually formally registered.

Good luck.

Hi D,

Thanks so much for replying to my post!

It's registered in her name. She registered it in 08 it has a number 2 ranking and 95% relevancy rate. She has, as of today, started to populate the page with her content. I've heard the older the website the better it does in rating. Is this true? I'm heartbroken, further more, I have all my blogs linked to the site which have the same name. Any other advice you can give me, or a curse or something ; )

I feel extremely frustrated by this thief.

well.. tell her that she/he is being unfair because it was your website not his/hers and you can tell him/her to give it back or to make you one and he/she can keep that one
