How do I buy and transfer a .com name
The .com name belongs to someone in USA - I live in Europe.
I am paying € 9.000 for the domain-name so I want to do it in a safe way.

If it's an individual I would just shoot them an email and see what their asking price is. If it's a registration company then contact that company
Use an escrow service. I have been using moniker.com for several transactions like this one before and all of them were successful.
I would like to add that I am also located in Europe (Greece) and have done transactions for domains owned by US companies using moniker.com. You might also want to check http://www.dnforum.com There are many people there who will provide you feedback on escrow services.
Make sure you deal with a legitimate company. That is a lot of money (well, for me it is).
If it's a legitimate company, make sure it isn't some spoofed site. Do research on the registration company (and the seller if possible).
If you are dealing with an individual or a small company (the seller), look at the option of using an escrow company to handle the transaction.

Transfers of expensive or valuable domains should be done using an escrow company. As you are living in Europe, you may consider one based in Europe, e.g. SEDO: sedo.com, sedo.de, sedo.co.uk, sedo.ch ...
I've used www.escrow.com in the past.
It's also important to ensure the seller signs a contract stating that they are the legal owner of the domain, that no third party has liens on the domain name, that they grant you all rights to use the domain name, that they have no claim on trademarks using the domain name, etc.
Transferring the domain name is the easy part. Given the value of the transaction I'd certainly have a legal professional, ideally with experience in Intellectual Property as it relates to Internet domain names, draw up a contract.

Each Reseller has some sort of 'transfer' process. There should be something on the website. Find out which Registrar the domain is registered with. Sometimes, if you are transferring a domain and the Registrar is the same, the process might not be as difficult. Look up the domain name using WHOIS and it will tell you who the Registrar of Record is. Registrar's are DirectEye, Tucows, GoDaddy etc.
Resellers are someone like NetFirms. Typically you will be dealing with a Reseller. GoDaddy blurs the lines a bit as they have a business called Wild West Domains that acts as a reseller, even though they are a Registrar.
You will most likely need an 'authorization code' and the admin contact of the domain name must accept your request for a transfer.
You can only get the auth or authorization code if the admin contact agrees to sell you the domain name.

Well the following is a brief overview of domain name registration. You must first of all find a company, that registers domain names for instance you can go to go daddy dot com and check if that domain name is available. It seems like in your case it is available. But just confirm it this way first, if you find that the domain name registrar has it you can buy it directly from that registrar and bypass the "owner" because that way technically it has no owner and can thus be bought by anyone on the open market.
Alternatively you could visit the following swedish website robtex dot com,if you type in the name of the website you intend to buy you will get a ton of detail on the domain name like whether the domain is available for sale, the hosting servers if it's in use.The Taskbar has the following menu's graph, domain, shared, who is,blacklist, analysis and contact. If you click on the who is tab you will get the name of the registrant, the registerant is the name of the person to whom that domain name is registered to.
After having done the above and being absolutely sure that that person is the true owner of that .com domain, then you can proceed with your transaction and pay by credit card, paypal or any payment service of your choice. You can then buy the domain and have your name registered as the registrant/owner of that particular. This too you can confirm by using the above named website robtex dot com that has a lot of detailed information on domains all for free. I hope

Do it through www.escrow.com, it's the safest way. Your money will be kept on escrow.com until you receive your domain name. Only then the money will be sent to the seller, otherwise if something goes wrong while you are transferring the domain name you will get back the money.
See attached image, it's a screenshot of my domain name selling to someone else through escrow.com. it was successful.
