We bought a condo in a new development and the developer is selling one of the common areas to a new neighbor, can he do that? it is legal?
The building is a three flat with a total of three units in Chicago. The land survey in our contract (and also in our other neighbor contract) shows that the common area in dispute (a large room) is considered a common element,

This is a contract dispute. You feel that the common area is part yours via the buyers agreement/purchase and sales agreement you signed when you bought the condo and the developer feels that the area in question is *not* a common area at all but is an area he/she has every right to sell.
You should have an attorney read over your contract and show him./her what is going on at your home. A qualified attorney with experience in this area will be able to tell right way if you have a case, problem is that everything is at your expense and you will likely never be reimbursed for it. I can say from experience that the developer is counting on this to prevent you from acting legally.
