it was Merrill's obligation to disclose anything prior to the close of the merger...as far as ethics, I mean whatever, it's finance

BoA will pay $33 million in fees for failing to disclose Merrill Lynch weak financial. After the merger, Merrill Lynch reported a loss of $27 billion.
