Well, they didn't say that he DIED or anything... they just said that he had pancreatic cancer.

Now, if they said that he HAD DIED, then yes, it would have been inappropriate.

No, not really. I believe that he has agreed to let the Enquirer run the stories and in exchange his family will benefit from it monetarily after he is gone. I think they do have a deal. I am pretty sure that is how these things have worked out in the past.
