In theory they can build any boat at all and name it the "Titanic 2". In fact I would be shocked if many ships hadn't been thusly named.
But the answer to your questions is: YES.
There is a cruise ship, to be named Titanic II which will launch in April 2012 (100 year anniversary of the tragedy). Titanic II will retrace the route taken by the original ship and will serve food that matches the original menus of the Titanic.
Tickets are already eagerly being snapped up at $3,000 a piece (which as my source reminds me, is quite a deal considering that the original first class Titanic passengers would've paid the equivalent of about $69,600 in today's dollars for the original voyage!).
You know, sometimes I really if it's a good idea to tempt fate. If you believe in gods of chaos or irony, maybe you should take a pass on this cruise!

*****It's true - I didn't read your question properly, so instead, here's a pleasant (yet irrelevant) short tale with a video to boot ;)
:::::ORIGINAL (WRONG) ANSWER FOLLOWS:::::
My boyfriend tricked me the other day - he showed me a trailer on Youtube for "Titanic 2".
The thing is, it was set in the future - the idea is that Jack was frozen in the ice when he died and then in the future they discover him and get him out...
I totally believed it...
Then he told me it's not real!! :o
I was so mad, for a bit. It is good though - it's just made up of loads of different clips from films Leonardo Di Caprio has been in!

Back in the real world, all I can find when I search for any variation on "titanic sequel 2009" are results leading to this same fake trailer :(

Will there be a Titanic 2? (Ocean Liner not Movie)
I remeber hearing something about them building another...is that still in discussion?
If they do bring the old Titanic back to surface will they use that to rebuild and to learn from mistakes so it's stronger?

I was so dying to say that there is just no way they would tempt fate like that. But, apparently I was wrong! I had no idea they were making another one and I can't imagine the crew that would go on it if they are as superstitous as sailors used to be. Wasn't tempting fate by saying it was "unsinkable" once enough?

I wouldn't of imagined them doing that again either but I guess...tempting fate seems like a good idea...but Imma steer clear of that ocean liner...and watch the news very attentively.

I do believe in irony and I don't think the bottom of the ocean is my ideal resting place...I hate the ocean...
Or the original route taken...
