M$If the Asker fails to choose an answer and does not select "No Best Answer" questions go into the Undecided Questions queue, where again "No Best Answer" can be selected by the community and the tip will be refunded.

M$Perhaps, Mahalo absorbs it. If you remember there was this one question that asked what happened to the money from the "interesting question" vote tips. Apparently Mahalo absorb it, if no best answer was selected.
But if they received their money back I guess it's fair. If they used their own money and got answers they weren't comfortable with, then I guess it's fair they get their money back. But it's unfair to do it too often.
Although, if they do this too often then you can turn them in to the staff. Also, you can claim that it was unfair to choose no best answer, by going the question and explaining why. If enough answerers complain the staff will make a decision. :D
