According to the Second Amendment Foundation, Judge Sotomayor's nomination is a "slap at gun rights and the Second Amendment."

Their reason for this statement stems from the ruling of the case Maloney v. Cuomo from January 2009, in which Judge Sotomayor ruled that the Second Amendment only applies to the federal government and not individual states or cities. According to Judge Sotomayor, it is constitutional for your state or city to ban gun ownership. However, it's worth noting that the case above involved martial arts weapons and not guns.

Expect lots of hard questioning from senators close to gun rights groups during Sotomayor's confirmation hearings.

Sotomayor has said that she feels the Second Amendment's right to bear arms applies only to the federal government, meaning that individual states could theoretically dictate their own local laws limiting ownership of guns. In the case of Maloney v. Cuomo, she permitted a New York State ban on owning martial arts weapons to remain intact.

Some private gun ownership advocates have expressed concern that Sotomayor would permit states or areas to completely ban firearms.
