Randall Terry, by his own admission has been arrested over forty times. It prosecuting attorneys in all those cases found no reason to seek a long prison term for terrorism, it is likely that the justification for such charges does not exist. It would make a prosecuter's career to be the one who put Terry in prison, yet on 40 occasions, when they had the opportunity, none of the legal professionals thought they had a good chance of winning.
In order to be imprisoned for being a terrorist, charges would have to be brought and Terry would have to be found guilty, and then sentenced. In the absence of that, the obvious answer to your question is NO, of course not. Not one citizen in the United States ought to be in prison if they have not been charged and found guilty (Terry has not).
Continually calling Terry a terrorist doens't make him a terroist in the legal sense.
NOW tried to sue Terry, but their goal was a payout, not a prison term, as evidenced by the settlement they accepted.
