Should the sale of violent video games to minors be a crime?

The United States Supreme Court will be hearing a case concerning the constitutionality of a California law making it a crime to sell or rent violent video games to minors. California has proposed treating the violent games much as they do obscenity, pornography or "adult" materials. A decision is expected in October, 2010.

I very much believe that young kids should not be able to purchase any of the first person shooter games. My youngest son now 18 had a couple in the last few years that I wish he did not have. However, he would take his money or old games into the local card and game shop where he was free to choose what to buy.

I did not always agree with his choices, but since he purchased them when I was not with him, I could prevent his purchase. I do know the owner in the shop personally and he will not sell mature games, which are full of violence, sex and the other bad stuff to anyone under the age of sixteen. In this is a small town where everyone knows each other, he usually knows his customers.

Yeah I believe they should prevent young kids from buying the bad games, and if the owners of the shops continue to sell or rent them to kids, they need to be fined.

Only if it's illegal. It would be great to be able to legislate effective parenting into existence, unfortunately it's impossible. Laws with the best of intentions don't work as well as education.

Who would be injured if it were made illegal? The hapless the video store clerk, probably paid minimum wage? It seems wrong that person would hope more responsibility for the child's actions than the parents or the child themselves.

As a video games seller, I must say I find this hilarious. I’m not aware of the USA laws against video games, but based on the video you posted on your question, I honestly say this is hilarious. As long as video games are rated and the seller asks for an ID from the buyer, to certify his age, I don’t see where the problem is. In addition to that, I personally think that even if you ask for an ID, you can’t prove that the buyer will play the game. Can you?

There was a similar case several years ago, when a kid played Counter Strike for 2 days and 2 nights, than he took his father’s gun and killed his family. All of them. I can’t remember where that happened: Japan, China or USA, however that’s not important. Was the video game seller guilty for that or the parents who allowed him to play for 2 days?
Let’s face it…soon, video games stores will disappear. Every game will be purchased online and this already started with sources like Steam, XBox Marketplace and so on.
Not to mention that you can download any video game from a torrent website and if your console is moded you can play it.
Who can verify the age of each person that hits the download button???? Nobody.
Family is responsible for what a kid plays and how much. That’s it.

I don’t have any real problem with selling video games that are rated for older ages, to minors being a crime. The problem I would have with this law is just how strictly it is enforced and what the ensuing penalties would be. I don’t want someone going to jail because they sold an especially violent game to a minor. That would be a wild overreaction to something that is a pretty small problem.

If you are talking about issuing a citation, something with a little more financial impact than a parking ticket, I would be all for that. It should even be less of a fine than selling cigarettes or tobacco to minors but still be a bit of a reminder that there is a law against selling certain games that are rated not acceptable for minors would be acceptable.

That's what my son says. Give them a ticket and make them pay a fine. Jail is a bit harsh. I think I could go along with that.

I look at it this way, have laws against teens drinking stopped teens from getting alcohol? No. Do you really think something like video games that even more adults are going to see as harmless is going to then be successfully kept out of the hands of minors by a law? Logic says no. So whether you believe teens shouldn't play violent video game or not (I personally as a parent see the whole idea as silly games don't make kids violent bad parenting does.) it's unrealistic to believe this law will hurt anyone but sellers who would have to jump through more hoops and the US government who would have to fight another "war" on something they'll never beat. Not to mention making something illegal often only makes it taboo and more appealing to youth.

I think the parent should be in control of what is deemed violent. I personally was able to distinguish that video games are fake, and I never committed a crime due to a video game even at a very young age. As a matter of fact I recall Mike Tyson's punchout was part (small part) of the launch in my boxing career, as Mike Tyson was my favorite person at the time and I was naturally talented and athletic.

Not all children have the same mindset, so my answer is this: If the legal guardians are present: anything goes. I will not link you an answer. Here it is.

I know some parents aren't the best judges, but if they do thier research and thier child is or isn't prone to violent behavior, they should find thier ANSWER.

As much as I like some of them, yes, it should. There is often a LOT of adult material in video. Little 7 year old kids do not need to be playing those things. It can have just as bad as an effect as pornography, or even worse. If they get it instilled in their head that violence or those things are normal behavior because they play games about them all the time, it can be very damaging to them growing up and to our society as a whole.
