The CIA used "inhumane" tactics to interrogate terror suspects. Should they be prosecuted?

A criminal investigation into the interrogation methods enacted during President George W. Bush's "war on terror" has revealed that CIA interrogators:

—Forced a detainee to watch his mother being sexually assaulted.

—Threatened a detainee with a gun and a power drill.

—Staged a mock execution of one prisoner to scar another prisoner.

—Threatened to kill a detainee's children.

The AP wrote:

"Obama has said interrogators would not face charges if they followed legal guidelines, but the report by the CIA's inspector general said they went too far—even beyond what was authorized under Justice Department legal memos that have since been withdrawn and discredited. The report also suggested some questioners knew they were crossing a line."

Should these interrogators be prosecuted? Should the people in power who oversaw these interrogations be prosecuted?

Yes they should.
Not prosecuting them would send a message to the world that the USA has something to hide, and will condone illegal activities as long as they can flag it as 'war' or 'required'.
Prosecuting doesn't mean they are going to be convicted. It means that a third party will investigate their behavior, and validate their actions against (inter)national law. This way, the discussion on whether their actions were legal or not is fully discussed, and a conviction or not is based on law, not on political issues.

If these interrogators are going to be 'off the hook' by a political decree, why
would they or any soldier keep within boundaries the next time?

The worst crimes are committed during war, and these crimes need to be condemned, even when performed by your own soldiers.

This is a hard question to really answer. I see a lot of people saying yes they should be, but think about it this way, What if these people were going to kill your family?

What if they were the reason why 9/11 happened (I actually think bush planned that out but that’s another story I am playing devils advocate atm)?

Do you feel that we should hold better morals when trying to protect people’s lives (Not only American but other countries such as the UK and such?) when we receive videos in the mail of them beheading our news reporters and soldiers for all to see?

Do you not think that other countries do FAR worse things, such as IEDs killing millions of our soldiers?

How would you feel if your son/daughter/wife/husband was one of those beheaded on TV?

Would you feel that you want it to never happen to another person no matter what?

My true opinion is that threatening someone to get what you want is fine, as long as you don’t ACT on that (as in don’t actually rape his mother in front of him).

We are stuck in a tough spot at the moment, one we should never have been in, in the first place. We should never have gone to the Middle East, the UN DENIED us the war, yet bush felt it was all right to ignore them.

We went into a country and are trying to force OUR opinions onto them. We claim we are over there to stop terrorism, yet I never see us attacking Russia (they believe they might be at fault behind some viruses). I don’t see us going after N. Korea. Bush went into the war hoping to do what his daddy couldn’t and he did a lot of damage; Not only to our credit, but to his party, his shady plans caused a major economic fall and not only the lives of Millions of soldiers but lives of those struck by Hurricane Katrina.

Its funny, people say we are America, Anti-Communism...Yet who is one of the countries we do most of our business with? Could it be the BIGGEST Communist Country?

I feel that if they actually received information from these detainees and stopped some attacks (and they can prove it) then they shouldn’t be punished, however if they did these things and received nothing from it, then there is going to have to be some REAL explaining to do and some butts getting beat.

I do feel that they need to put away the whole water boarding and such stuff. I stared at the picture above and thought how it would feel to come inches from drowning and what would happen when they finally gave me my first breath...I felt like throwing up.....

There are a lot of factors in why our soldiers do things when faced with the stresses of war! I don't think that this question has a simple yes or no answer! These cases that you hear about are not even the tip of the iceberg! People do weird s**t to other people all the time! I think that these instances should be at minimum reviewed, disclosed to all, apology's made and learned from. This is a case by case thing! As twisted as it is, I would rape my own mother if I believed that It would save 10-100 lives, Americans or otherwise and I have never been "in-country"!

There is no question about it, once the investigation finds that people were mistreated and tortured, then those who are responsible should face jail time and be made serve the full sentence, not to be released after a few months which has happened in the past. Remember Vietnam and My Lai. This was a war crime yet the perpertrators were out in a few months after being found guilty.
America should show the world that they will not tolerate mistreatment of any person regardless of the crime committed. They must rise above all this and become leaders in humanitarian efforts to rid the world of hatred and enmity among mankind.

Yes... they should.

Either they knowingly broke rules/regulations and laws in which case they should be tried, and if found guilty sentenced.

OR

They were ordered to do so. In which case, they should be tried for their conduct and then the offices who ordered them should be next.

Simply saying "they were stressed" or "there was a war on" is not an acceptable defense for their actions (although it may be useful in mitigating their sentences where applicable)
