Should Sean Penn go to jail?

Should Sean Penn go to jail after attacking the cameraman that was hounding him? Before we just assume that it is just a celebrity with the occasional snap, first know that he has a history of attacking people. 6 cameramen in all, an extra on the set of a film he was making, and a guy who he suspected had kissed his then wife Madonna. All priors however are over 20 years old and are not supposed to have any weight in court. He is set to go to court soon. Will the court look past his priors like they are supposed to? Will he go to jail (facing possibly 18 months? Does he deserve to go to jail? I would like your oppinions, and whatever legal knowledge you might have on the situation.

Paparazzi stink. I wonder how Princess Dianna would answer this question. Sure, they have a job based on public demand for all things celebrity. But it's tragic. In The US we have the right to live our lives in a lawful manner without threat of interferance from anyone else. Celebrities do not deserve to be hounded by persistent photographers every hour of the day. There should be a standing restraining order against that type of behavior. Pure speculation, but I wouldn't be surprised to learn that the photographer in this instance was soliciting just such a response from Mr. Penn, knowing full well that he was prone to outbursts if provoked, and knowing full well that he could benefit financially from such a confrontation. You think Mr. Penn lacks the intelligence and has such little self-restraint as to just hit any photographer that comes near him. I wouldn't be surprised if the photographer was completely out of line in the moments preceding the incident.
I doubt Sean Penn will do jail time. He's got the money, and some, for more than competent representation. If his legal team hasn't bargained their way out of a trial by now, I suspect they're working on it, or they have no fear that a trial will result in jail time.

Good points, but do you believe he deserves to go to jail or get off the hook? They are going to trial, so does that mean you think the courts will overlook his priors, and focus on this as an isolated incident?

I can only imagine how a celebrity might feel being followed all the time. However, I do believe that what is good for one person,( no matter celebrity or not) should be good for all. So, yes I think he does deserve some kind of jail or prison time for it is assault !!
I know that "THEY" say that your prior record will not have any effect, but I do not believe that. I feel that a policeman, judge or any other authority person can ly or say whatever they want to. I am living proof of that !!

Yes, he should go to jail for assault. But, I'd be happy if he got off with a warning. And then punched another one in the face. The hounding of celebrities so their skeletons can be used for ratings is pretty ridiculous, and its not like there is anything else they can do about it.

Heh,,,I haven't showered in 3 days. If someone attempted to take my picture solely to make my current nastiness their profit I'd want to knock their heads too.
