No. After reading the story (See references below) it appears that it was truly self defense. The intruder (Sean Kennedy) was drunk (3x the legal limit) and apparently DROVE in that condition. Parson shouted at Kennedy to leave. Kennedy broke a window and was in the process of unlocking the dead bolt when Parsons fired. Yes, he fired three shots, but in the heat of the moment I can't say I blame him. He had his girlfriend in the house and believed whomever was on the outside as very determined to get to them.

While I sympathize with Kennedy's family, I feel that Kennedy was irresponsible for drinking that much knowing he had to drive home. He then got into his truck risking the lives of others. Had he not been intoxicated, he would have realized that he was at the wrong house and this would never have happened. Had he taken a cab home, he would have been taken to the correct address and this would never have happened. In other words, I believe that Kennedy is to blame for this and not Parsons.

While I do believe in self-defense and the right to protect your home and family, I also think this case highlights some flaws in the legal system. Under Colorado's "Make My Day" law James Parsons was not charged with shooting and killing a drunk intruder, Sean Kennedy. From what I understand, Kennedy was breaking into Parsons' home despite barking dogs and Parsons shouting at him. There is no way to know if Parsons could determine that Kennedy was drunk and thought he was breaking into his own home. Parsons' girlfriend had supposedly called 911, so I think they should have waited for the police to arrive. As far as I know, Parsons did not even fire a warning shot, but rather, shot Kennedy three times. Also, it is unclear if Kennedy had any sort of weapon. So, yes, I do think there should have been some legal ramifications against James Parsons for killing Sean Kennedy.

You are high, stop hugging trees, this is real life. If someone is coming in my house, there are no warning shots, because they could be on meth, cocaine, pcp, and they won't care. As well, if they are determined to come in and you are warning them verbally, and they keep coming, to me, I deem them a psycho, and then I cleanse the gene pool. You can wait til the cops, I mean, the meat wagon comes. Me? I'll wait for the cops to come take my statement when I'm done putting the dog down. My guess, is that before they murder you, they will rape you too, but that's ok, you just wait.

The entire incident happened over 4 minutes. Kennedy ignored Parson's shouting at him and the dogs barking. You don't think that Parson had a right to panic when it appeared the intruder was not going to stop until he got into the house? Police can take 10 to 15 minutes to arrive. He only shot when Kennedy was reaching for the dead bolt lock.
