The Supreme Court has already ruled on this, saying essentially that as distasteful as flag burning is, it is free speech and is protected by the constitution. In fact, when someone burns the American flag, I'd feel the best response would be to ignore them and not give them any publicity, or failing that, remind them that tens of thousands of US soldiers have dies under the flag they're burning, among other things, to protect their right to burn the flag, adding that having that right does not mean it is honorable to do so. It isn't. In fact, it is shameful.

Just to keep the record straight - ultimately every American flag should preferably be burned.

United States Code, Title 4, Chapter 1, paragraph 8, part k reads:
"The flag, when it is in such condition that it is no longer a fitting emblem for display, should be destroyed in a dignified way, preferably by burning."

This code also stresses that the flag should be respected at all times. It should never be used as the graphic on a napkin or other disposable item, etc. Smearing the remains of 4th of July celebration, greasy ribs from your mouth onto a paper flag seems a lot more demeaning than burning a flag to make a statement about your personal opinion or beliefs - something we are free to do in this country and which is highly envied by most of the rest of the world.

If you really think about it, burning a flag "in protest" is the ultimate use of the US Flag in that the very freedom to do such a thing is what the flag represents. It's poetic in its way, to those who take the time to really understand the US Constitution, the Declaration of Independence and all that our Fore Fathers bequeathed us. (Our Fore Fathers being truly great Statesmen who dreamed of freedom for their children's children vs modern day socialists who incite mock-outrage with half truths/half information to herd unthinking voters into limiting individual freedoms.)

The answer to your question is "No, burning a flag should not be considered treason."

It would be terribly ironic to call that treason. If expressing freedom is treason in the United States, then the United States is no longer a country of freedom, and there's no sense being loyal to it.

I once clipped a letter to the editor, written by a World War II veteran. In short, he said that he did not fight a war and watch his friends die to come home to a country where someone did not have the freedom to burn the flag. He said it would sadden him to see a flag on fire, but his sacrifice was for freedom--not one man's idea of freedom, and not a politically correct freedom. Just freedom.

Demanding that someone stop burning a flag should be considered treason, if anything is.

I would go so far as to call it treason, but some kind of offense is only right. The flag is a national symbol of freedom, and just because you have the freedom of speech and religion, doesn't give you the freedom of being a disrespectful jerk. If you can't think of anything else to do with it, then donate it to your local veterens affairs office or military office.

If you would deny a disrespectful jerk freedom to burn a flag, then you have no concept of freedom, only a concept of control.

No it can not be treason as it is only a symbol. It does not actually hurt the Country as in giving up secrets but it is a thing that could get someone punched in the face.
