Are the legal disclaimers used in e-mail signatures actually legally binding?

Some people get really into making the legal disclaimer sound as intimidating as possible. Are there any laws or past instances where a legal notice in an e-mail signature has actually been upheld in a court?

They can be. If the email message is between two entities which enjoy a privledge then a violation of the disclaimer can constitute a violation of that privledge. For instance lawyers put this disclaimer at the bottom of almost all their emails as a warning to people that if they release the email message they could be liable for releasing privledged information.

Boiler plate language between two people who not previously agree to the terms and conditions is not binding.
