It's marketing speak. Most quotes like that are meaningless unless it is used in context. The tag can be, 'X is the number one comedy in America', but they don't tell you anything about how many theaters it is in, what demographic they are pulling the data from, how well the competition is doing, and on and on.
They aren't lying, they're just omitting the details. All perfectly legal. Unfortunately, the majority of American's aren't smart enough to educate themselves, and will accept anything they're told.

It's similar to how the New York Times bestseller list works. Clearly only one book can truly be the "best seller", but there are tons of books who advertise themselves that way just because they were on the list, even if they weren't at or even near the top of it on any given week.

It's easy. You just pay for reviews. Since "best" and "worst" are very subjective terms you can say a movie is the best without it being totally false (nor true). It happens a lot with books, which are usually advertised as "the best after X", "The new Don Quixote" or whatever. If you were a company, would you advertise a movie with something like "it's OK. Not the best movie of the year, but watchable"?

For the same reason that politicians can proclaim themselves experienced, looking out for their constituents, fulfilling their political promises, maintaining integrity, and never ever having committed no crimes not at all and how dare you question their spotless reputation. Because there's enough idiots that will think it's actually true.

Generally, when you see that ad, it comes right after opening weekend. If that movie did the best that weekend out of all of the other movies in the theater, the ads will say it's the "#1 movie in America" or something like that. That's how they justify those claims. It's similar to how the New York Times bestseller list works. The other thing you will hear them say is... The #1 Comedy, or Drama Or Dramedy or Thriller. It is not always the #1 movie overall, but if they make up a genre or some other descriptive word for the movie and put #1. Bam they have a #1 movie on their hands.
