Mike Tyson will not be be prosecuted for punching a photographer. Um, make that "allegedly" punching. Did the judge make the right call?

Mike Tyson is someone who is convicted for his violent acts.
But the judge sided with Mike Tyson on this one while in many cases, prior conviction usually works in the persecutor's favor. I can think of several possibilities: the judge is getting sick of paparazzi harassing people and thus sided with Mike Tyson or the violence is over-exageration from the paparazzi.
A lot of times I feel that paparazzis should be severely punished for some of their behaviors. Especially after Princess Diana's incident, I have hoped that the lawmakers make some law against this type of harassment. Either Mike Tyson is found guilty or not, this time I actually sided with Mike Tyson though I don't like him one bit.

M$1) The Paparazzi swung first.
2) There is strong reason to believe that Mike Tyson did not throw a swing.

M$So, again, if the judge didn't see enough concrete evidence then I'm sure it either wasn't there or there were some kind of extenuating circumstances.
Here's what another news blurb had to say:

L.A. prosecutors say they won’t press charges against him or photographer Tony Echeverria for their Nov. 11 scuffle at LAX.
The photog says Iron Mike, who did time for rape and has a drug conviction, knocked him down.
The ex-champ says he was trying to protect his family after the photographer collided with his infant daughter’s stroller.
Tyson’s lawyer, Shawn Chapman Holley, hailed the prosecutors’ decision as “a small victory for those who continue to be harassed, annoyed and even stalked by the paparazzi.”
