Is it legal for a 16-year-old to consent to intercourse with an 18- or 19-year-old? Or, is that statutory rape?

Primarily, the answer depends upon the laws of your state. Currently, 34 states and the District of Columbia have established 16 years as the age of consent. However, according to 4Parents.gov, “A common misconception about statutory rape is that there is a single age at which an individual can legally consent to sexual activity.”

In fact, only 12 of 50 states (plus D.C.) have single ages of consent, which range between 16 and 18 years. In each of the remaining states, the age of consent can be affected by up to three factors: (1) the minimum age of the “victim”, (2) the minimum age of the “defendant”, and (3) the age gap between the victim and the defendant.

In CA, it’s technically statutory rape, but the question is will it be actionable? A lot depends on the details (as the saying goes), and each case is treated differently. It’s not like being drunk behind the wheel, where it’s almost a guaranteed arrest.

i dont think it is rape, i think it is ok if consented, after 18 i think it is all legal.
