Warning About Legal Questions

My local cops would not do anything about a Diesel truck that almost hit me today, what do I do, more of the story is below
Ok my boyfriend was driving, we were getting off a bridge when we were almost hit by a truck on the High-way, this truck driver could have pulled over, so my boyfriend is pushed into basically the bike lane. Then my boyfriend get on the side of him and out of rage, he well flips him off, then the truck driver started to pull his truck near my car trying to scare us, when I realized he was on the phone, and he was trying to hit us on purpose, I got his plate number and was about to call the cops when we saw a cop on the side of the road, so we pulled over to talk to him, we told him what the guy did and that he was on the phone, and then the cop said ok, the cop left acted like he was going to try to catch up to the truck, but just turned a little ways down. My boyfriend says maybe he got another call, i think it is messed up that he did not chase that jerk down. What can I do to make sure this person gets caught?

I have the plate# but I don't think the DMV will give me the information, and the HP did not do anything, I actually think that is what we talked to. *Sigh* this is the 2nd time a truck almost hit us, well the first one was a truck with a horse trailer, again they tried to run us off the road. Crazy drivers.

Do you remember if it was a county sheriff or city or state? Go to there local office and press charges. Remember you have to know the time ,description of the truck, highway you were on and the officer you spoke too. If you do not have his name, they will know who it is by means of shifts and patrol areas. Have them verify the incident with the officer you spoke with and go from there. If that does not work go to the county's prosecuting attorney and insist or charges being brought up against the driver. You have the right to press charges. You have the tag number so it should not be a problem finding the perp that was driving as long as you have the rest of the information I stated above. Also call the trucking agency if you have there info and file a complaint with them. Road rage is nothing to sneeze at, it can and has escalated into traffic fatalities in the past. Anyone that uses a vehicle to scare or intimidate someone should not be on the road.

Of course he flipped him off the driver almost killed us, it is better than anything else that he could have done.

I have a co-worker who was in a similar incident with an 18 wheeler who changed lanes without warning. In his case, he was run off of the road and hit a concrete embankment. He contacted the trucking company and provided the tag and trailer number. They told him that after talking to the driver that they didn't believe that it really happened. He then talked to the local police and filed a police report. The police officer told him that there was little they could unless the truck actually hit him. Long story short - there is little that you can do, sorry.

Yea the first one that happened we hit a concrete embankment. Sadly my boyfriend must have miss read the truck company name. It was something like McVey. In California. *Sigh* So no good.

Unfortunately, unless a cop actually saw something like the truck trying to hit you, there is not really anything they could do. It would be the truck driver's word against yours and nothing would come of it since no actual crime was committed. By your own admission, your boyfriend flipped off someone driving an over 10,000lb vehicle. I understand his annoyance, but he needs to keep cool for everyone's safety. Also, are you saying that you were merging off of a bridge onto the highway? If so, it's your responsibility to yield to the oncoming traffic. Even if the truck could get over, they don't *have* to. Sorry if I misunderstood what you were saying.

There is two of us though. So yea. Plus I am sure he will drive on the phone again. IN THAT BIG TRUCK! Scary. He could have moved over. It is called respect, thats why people move over, it is just begging for an accident.

Plus the guy almost hit me, it could have flipped well spun my car and killed me, since it would have hit my side. And I am a small person, so it would have sucked.

I agree that it sucks, but without it being seen by police, you have no proof and thus no charges could have been made.

Report the driver to the trucking company, file a police report if you like, but don't neglect to get some anger management training for your boyfriend. He should have backed off and gotten some distance from this dangerous driver instead of provoking the situation.

Ok, I did not write this question to have people insult what my boyfriend did, he was not in the wrong. The truck driver on the cell phone was in the wrong.

If you have the company name, number of the truck that was driven and phone number, then I would call the police on the driver for road rage. I know in my state you can get in big trouble for road rage and threats.
