If you have further problems, you will have to pay again, your only way to recover damages from the original surgeon is to prove that the surgury was done incorrectly, if he didn't make a mistake, and your body just isn't responding as expected (medicine being an imperfect science since the body is so complex) you don't have any recourse against him. You can accuse him of botching the original surgury but unless you have proof your nowhere, in a court's eyes it could have just as much been you not following proper rehab procedures. You may want to get a second opinion though to see if theres a medical basis for saying the original surgury went wrong. Otherwise, if you need another surgury its on your dime.
