Unfortunately, excellence24 commits the popularity fallacy in his answer to the question: one cannot infer legality from the popularity of a practice.

The answer to the question is that using the name, likeness, or identity of another, especially that of a celebrity, without his or her permission and for one's own benefit, is called appropriation. People have been successfully sued.

Whereas appropriation falls under "invasion of privacy" for private individuals, the issue is different for celebrities. A celebrity may sue for appropriation on the premise that s/he "owns the right to the publicity and the monetary rewards (or damages)" that arise from using his or her name, likeness, or identity.
