Jalopnik reported in late '07 that it was indeed legal for the passenger in Tennessee to have an open container.

I thought it was pretty nationwide that there could be no open containers in a moving vehicle, but apparently the federal government only gives recommendations in this area and the states can choose to do what they want. 11 states in all don't adhere to the no open container policy...
