Is a store really not liable for damage to a vehicle by a shopping cart?

I know most stores post that they are not responsible for shopping cart damage, but would that hold up in a court?

Of course they aren't! Why? Because it's not unforeseeable. Like an occupational hazard, certain thins happen so often that they are considered unactionable by the law.

It would be a different story if cameras caught someone maliciously slamming a cart into someone's vehicle with the intent to damage it, but for the random cart dinging your car – nope. It's just not uncommon enough.

For the same reason, amusement parks cannot be sued for headaches, dizziness, upset stomachs, etc. They are inherent risks, like shopping cart dings at the supermarket.

they are not held liable for anything that happens outside the store. I found out this the hard way. Someone stole my waller out of my car and when i went to ask them about it the security guard said they were not liable outside the store, inside yes but not outside.

Hope this helps.

Thanks Mike !
