Why I am being audited for stepchildren I claimed in 2007, I no longer claimed them in 2008?

Me and the childrens mother were together for 2 years until March 2008.
We split and I no longer provide for them anymore. Now the IRS wants evidence that I provided for the children. How do I resolve this?

Assuming that the children lived with you and the children's mother, I would begin by assembling all of the bills that you and she paid in 2007, especially the rent or mortgage. Then I would make a note of who paid what bills. If you can show that you paid the bills for the household, or a significant amount of them then you may be ok.
You may need to have a tax consultant go through your stuff and analyze it.
Generally, the rule is that if you paid more than 50% of the child's expenses then you can claim the child.

That's a very helpful answer, I think providing as many sources as possible for this is the best. Obviously this is an individual issue and we'll never know the actual answer to their situation, but this definitely provides them with the tools to help prepare them for the inevitable battle with the IRS.
