Cable companies monitoring their customers' internet usage? Copyright infringement? Blah blah blah...

So my dad got an email today from our cable company. They said Warner Brothers is threatening to sue us because someone from our IP address downloaded Harry Potter and the Half-Blood Prince in July. Isn't this invasion of privacy? Does this mean if I download porn on my computer, they see that too? Freakin' pervs...

Has any one else been in this situation? What did you do? How do I correct it? I'm told that I have to delete all files from that download and provide proof that it's gone. How the hell am I supposed to provide proof?

Somebody help me out here!! I have a wedding to plan and that's stressing enough for me.

I have read the privacy policy of my cable company:

Hi, this is only from my personal experience/opinion so please don't take any of my words seriously.
From my understanding when someone downloads Torrent files it's not tracked but when you leave it in your share folder and others download from your pc that's why they can track it. So, I don't think they watch you viewing porn.
I believe as long as you delete the or at least hide it so it doesn't get uploaded then that should be fine. That could explain why there's less and less sharing of files through torrents now. Just a thought, what would happen if you went out and bought a boot leg Harry Potter and the Half-Blood Prince DVD and said that you played it during July on your pc, and it just happens that you had your share software on at the time. Is that still pirating? After all, you bought the DVD although it's bootleg.

Yeah, I understand what you're saying and you're right. On PTD's Residential Policies page it says that it's not illegal to download these files, but it is illegal to share them.

Under Illegal Activities it says:

Unlawful Use: PenTeleData is not to be used for purposes contrary to Federal, State, or Local ordinances, regulations or statutes. Copyrighted, patented or trademarked materials are subject to the Intellectual Property Provisions of this Policy. Additionally, you may not, by use of any PenTeleData or another service, upload, post or otherwise distribute or facilitate distribution of any content, including text, communications, software, images, sounds, data, or other information that contains viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.

Copyrighted Material: You agree not to post, transmit, display, or distribute through PenTeleData any content that infringes on a third parties copyright, trademark, service mark, or trade secret without the expressed written consent of the third party.

There is a way I can turn off seeding, but my boyfriend informed me that if I do that, the people who I'm leeching from could deny me access or something... It makes sense, but how does someone even find out who's sharing and who's not? You don't have to answer that. Rhetorical question.

I work for an ISP and I know that we send out DMCA notices. I think the way it works is like this:

1-Copyright holder monitors materials and P2P traffic.
2-Submits notice to ISP that material was trafficked to an IP
3-ISP takes it at face value and forwards warning to subscriber
4-If there is another complaint for that subscriber, they cut them off and send a second notice
4a-The customer can return the second notice and affirm that they have removed the file from their PC and we will resume service
4b-The customer can contest the claim and the copyright holder may sue

ISPs don't do anything until they are forced to by the law.

I read on Pen Tele Data's website that downloading is not illegal, but the sharing of copyrighted material is.
