The problem with torrenting is while you are downloading the information, you are also simultaneously being a host to uploading the same information. And so are susceptible to the penalties of uploading, even if your upload only lasted for moments. It doesn't matter if you delete the download, as catching you on the site downloading is proof enough of uploading.
Technically, simply copying the information from one device to another is illegal, but it would take great expense of manpower and resources to find people who are doing this, so they focus on the uploading.
Typical risks are usually just turning off your internet for a week, as a warning. On repeated instances, however, you can be charged with $250,000+ in fines and spend 3 years in jail.

I am not familiar with Xbox 360 modding, but if it is already modded, it is likely that you can make it play downloaded games with little extra effort.
It is not true that you can legally play a downloaded game if you delete it within 24 hours. The only time it is legal to possess a downloaded game is to already own a legitimate copy of that game that was purchased, or if the game is homebrew and given away for free by the developer. Also, in the event that you damage a legitimate copy of a game and need to download an online copy, doing so on a torrent site is still illegal. The reason for this is while you are downloading it, you will be sharing the parts you have already downloaded. Since you do not own the copyright to the game, it is illegal for you to do this.

It is not safe george15. Many people in the US and now in France have been fined or arrested by the government. IP-adress tracking is easy when you use torrents. Better use usenet search engines like this sites:

They use encrypted downloads, so they can never track your IP adress.
