Is it OK for someone to copy my YouTube video and repost it as their own?

I am new to this and it took me 4 hours to get my first video up on Youtube. My video called "Santa caught at mall" was beginners luck and the video has gone viral.

I was contacted and gave permission for TV stations, news organizations, etc., to air my video but some other people have copied it and reposted it as theirs.

I made a comment on one of the copycat’s video sites, entitled “Mall Santa Fail”. Uploaded by arredalhe9 on Dec 2, 2011, http://www.videobash.com which said:

“This mall Santa was definitely embarrassed after his beard and hair got stuck in a rope while repelling into Palm Beach Gardens Mall. I wonder what the children were thinking?!”

Here is the comment that I made days later:

“When you copy a video, that is already on YouTube, and you put it back on YouTube, over your name, you must credit Milly Olson, as the copyright owner of the original video. ALSO you must get a license from Milly Olson if this video is shown for profit. Copyright infringement is a serious matter. Please govern yourself accordingly”.

I was surprised by the following response:

@MillyOlson You are an idiot. You have absolutely no copyrights on that video.’

Am I off base with my comment on this copycat site?

Thank you in advance for advising this novice,

Separate topics with commas, or by pressing return. Use the delete or backspace key to edit or remove existing topics.

You can leave an optional "tip" with Mahalo's virtual currency, Mahalo Dollars. If you are asking a difficult question that might require some research, or if you'd like a wide variety of feedback, a higher tip often leads to more answers to your question.

Copying and reposting video as your own when you are not the originator is copyright infringement. Whoever reposted your video and claimed it was theirs is stealing from you. You need to contact Youtube and work with them to resolve this issue. If the person has made money from your video without your permission, you can take them to court to recover damages!
