Is a fair punishment for making prank 911 calls to be fined $25,000 and/or three years in prison?

I have to say that it could cause a big problem if someone was making a prank 911 call and an emergency call couldn’t get through, so what do you think? We have a new law that states it is now a felony for a person to make false or prank 911 phone calls. It also states that a person can be fined $25,000 and may have to spend three years in prison if they have been found to have made prank 911 phone calls. Do you feel that this is a fair punishment and why?

I would have to say that I do feel the fine is appropriate.
I realize there may be a few people that did not harm, that actually prank call 911, however, that one prank call, tying up the phone line or having police and paramedics rushing to that house may cost someone who IS in trouble their life.

If the police and paramedics were not going to that false alarm, perhaps they would have gotten to the real emergency in time to save a life.

If you do not put harsh consequences on this behavior, it is likely to happen more often.

This question is good. It is hard to answer.

I can see the pros and cons of both sides.

On the other hand, if it was a loved one of mine who decided to prank 911, I would probably have second thoughts.

The fine is appropriate when you are playing with someone's life. Even if it's slow at 911 center if you send an ambulance to someone who doesn't need it you could be tying that ambulance up for someone who does. I would also think the fine is up to $25,000 at the Judges discretion. As the Prison time says and/or this is at the Judge's discretion for repeat offenders.

That sounds pretty extreme to me. I've been in the 911 call center of my city a couple of times, and while call volume can be high, they're often sitting around reading magazines waiting for the phone to ring. Believe me, no prank call is going to do $25,000 worth of harm on one of those days. Even during a busy day, it will probably be apparent that it's a prank call and it probably wouldn't take up much of a dispatcher's time. Maybe for repeat offenders, it makes sense to have that kind of punishment to use as a threat or a last step in a disciplinary process, but I would hope they wouldn't immediately throw a punishment like that at someone on their first offense.

If someone is intentionally misleading emergency services, in order to waste time and dispatch responders to fake calls, I can see wanting to be aggressive with them. For your typical "joke" prank calls, where it's apparent it's some dumb kid (or overgrown kid), there's a much easier solution: hang up.

I think for adults the fine is appropriate. Actually I would make the fine 25% of the person's gross income from the prior year. Make it hurt even if Bill Gates pranks 911. They can work it off in community service if they don't have the money. I have problems with the prison time, though. I think prison should be for violent offenders only, and all other offenses should get fines or community service.

For minors, the punishment would have to be community service. After consideration I don't think we should fine parents for their kids' prank 911 calls. This is tempting, but unrealistic when it comes down to it. The kid who did the prank needs to learn the lesson more than the parent who left a small kid unsupervised or raised a jerk of a kid.

Great question! This is a a tough one to decide on. It's a bit like when some idiot at an airport makes a stupid joke about having a bomb in his luggage and then can't understand why all hell breaks loose!

From the idiots point of view it's just a prank, but said idiot doesn't have the brains to realize what the consequences could be if some one else could not get emergency help because of their call. Or would they even care?

I think a stiff sentence is appropriate in case like this, other lives can be put at risk because of the mindless morons who do this sort of thing, but I think there should be a large amount of publicity give to the consequences so that there can be no whingeing that "it was just a prank and why am I getting such a tough deal?"
