If I pay my mom rent + utilities, is she legally considered my Landlord? We have a written (through email) agreement for my stay.

Tip for best answer: M$0.37
Separate topics with commas, or by pressing return. Use the delete or backspace key to edit or remove existing topics.

You can leave an optional "tip" with Mahalo's virtual currency, Mahalo Dollars. If you are asking a difficult question that might require some research, or if you'd like a wide variety of feedback, a higher tip often leads to more answers to your question.

If it is written out then yes, Just remember she is your mom, and renting a room is a far cry from renting your own place.

There are still rules to deal with. Even in your own aprtment you have lease rule agreements.

And remember... if you're going to play by the letter of the law, so can your landlord...

If your mom owns the property and the money you're paying to her is considered "rent", and you're over 18 years of age, and you have a lease agreement, then likely legally she is the landlord.

An email contract is considered a valid contract in a court of law. See: http://www.allbusiness.com/legal/contracts-agreements/2378-1.html

While it's not exactly a "legal" document, any written agreement that you've signed can be used against you if the other party decides to sue.

Best advice: Pay your rent on time brotha.

Any written and signed agreement--that creates a contractual relationship--is automatically a "legal document," simply because it provides proof of the relationship.

legal document defined

However, that's not to say that it's "legally enforceable," which means that it would hold up in court. A legally unenforceable contract can be made enforceable by changing the contract.
