If I have a custodial account for my son (uniform transfer to minors act) that I recieved a 1099-B for - can I claim the loss ?

The acct is in his social security number. I moved the account from one broker to another broker (Scott-Trade - same type of custodial account). He is a minor and has no income to claim - but when we moved the fund (closed it and sold the shares) - it took a loss of $1200.00 - - so I am wondering if I can use that loss to offset other capital gains (stock sales) that I made in 2009?
