I recently won a judgment in California Small Claims court. Now how do I collect the money owed to me?

1. The court does not collect the money
2. Request that the clerk issue an writ of execution.

A writ of execution (also known as a writ of final judgment) is an order from the court allowing the judgment holder to attach or seize real or personal property belonging to the judgment debtor.

3. Complete an application for wage, property or financial institution execution and file with the clerk of the court where the judgment was entered.

4. An execution authorizes a proper officer to attach the debtor's wages, his or her nonexempt personal property or the debtor's bank account. (This does not include real estate.)

5. There is a $35.00 fee for each application for wage, property or financial institution execution.

6. A judgment may be enforced up to 10 years from the date of judgment.

The execution can be used to garnish the wages of the debtor or seize assets.

It's very hard to collect! I won in New York City and Ohio. There are several ways to collect though.

You can have the debtor volunteer to pay when they have the money.

You could have a levy put against the company if they have any tangible equipment. Costs money to do this.

You can garnish their wages.

You can pay a collection attorney (they get a percent) to try to collect by having them write a threatening letter.

You can have a debtors examination.

There are ways to see if they have funds in their account, as certain attorneys can do this.
